Filling Gaps in Your Case
Chronology
Litigator
Daniel J. Siegel was reviewing documents in an insurance bad
faith claim. “I noticed gaps in the chronology,” said Siegel.
“These gaps represented periods when the insurance company
should have been investigating the case and instead was doing
nothing. The delay was more visible when I reviewed all of the
facts chronologically and in context.” How did he get that
clear view? He used CaseMap, along with TextMap® transcript
management software.
Since each
fact in CaseMap can be linked directly to the source document
(e.g., a Cast of Characters, Case Chronology, Deposition,
etc.), Siegel could quickly view a given fact and see the
document to which it was linked, as well as any related
testimony from TextMap.

Identifying Clear
Discrepancies
When
working on an aggravated assault and murder case, attorney
Mike Rogers of Ronin Consulting realized that CaseMap could
help him make sense of conflicting stories told by his
client’s client and two witnesses.
Rogers
cross-referenced the police reports with copies of the
witnesses’ handwritten statements and the grand jury
transcripts. Glaring discrepancies became apparent as Rogers
started sorting through the data in CaseMap. He built a custom
report in CaseMap that allowed him to quickly bring attorneys
up to speed on the inconsistencies that appeared throughout
the information.

Linking Facts Quickly
In
Soldotna, Alaska, attorney Joseph Kashi was trying to settle a
case involving personal injuries sustained in an automobile
accident. Kashi was dealing with more than 150 different
medical bills covering one hundred or more medical and
physical therapy patient visits.
Even
though Kashi believed the medical documentation was clearly in
his client’s favor, the insurance adjuster strongly questioned
whether the entire stack of medical bills was related to
injuries sustained in the accident. “We could have been
looking at a long, expensive trial,” said Kashi.
Through
CaseMap, Kashi started linking facts—every medical visit by
provider, symptom, charge, etc. With the point-and-click
linking features, he could quickly cross-reference
information. It was easy to re-order the facts by symptom and
date and quickly pinpoint chart and billing data showing that,
in the specialist’s opinion, the injury likely occurred as a
result of the accident. TimeMap time scales put the vital
information into visual perspective. Kashi was able to quickly
develop a short, to-the-point demand letter that included a
PDF of his CaseMap reports.

How Does CaseMap Help You Link Key
Facts?
CaseMap
tools help attorneys like Siegel, Rogers and Kashi link key
facts and gain a clear picture of each case. Here are a few
basic tips:
1.
Link via Short Names
In
CaseMap, every person, organization, document, issue, etc., is
automatically assigned a unique “short name” for linking to
facts, other issues or objects. Once you have input “objects,”
you can link them to other facets of the case through the
short name.
2.
Link Summary Fields
This
feature automatically populates the connections or
relationships (links) between your short names. In the Persons
spreadsheet, for example, a value in each selected cell
indicates how many facts, documents, etc., pertain to an
individual. These numbers are automatically input when you use
Short Names on the corresponding spreadsheets. Just
double-click the number, and you get a report of all the links
associated with that column.
3.
Create and Save Filters
The
simplest way to create filters is to right-click on a “short
name” and choose Filter by Selection.
Example: If you need to view only “material” facts, go to the
Material column and click the word yes. Then
right-click on the word yes and choose Filter by
Selection. CaseMap will display only the yeses or
material facts. Click Print, and you have a
report of all your material facts.
To go back to
viewing the entire chronology, just right-click in any cell
and choose Cancel Filter. You can also create
advanced filters that cull information on multiple
selections—and you can save filters for future use.

Automatically Transfer Links from One Object to
Another
Have you
ever added two people as CaseMap objects and then discovered
they were the same person? Perhaps, for example, you realized
that all the facts, issues and questions should be linked to
John Smith, not Robert Smith. You can easily transfer these
links and remove Robert Smith as an object by using the Object
Link Merger. Here’s how:
- Before merging the links, copy all of Robert’s field
information that you want to keep from Robert’s record to
John’s record.
- To start the Object Link Merger utility, go to Tools
> Case Tools and select Object Link
Merger. Read the description and reminder; then
click Next.
- Select the first object, e.g., select
John
Smith, from the list of objects. Click
Next
.
- Select the second object, e.g.,
Robert
Smith, from the list of objects. Click
Next
.
- Select the object to delete, e.g.,
Robert
Smith. Click
Next.
- Confirm your selections before doing the merge.
- Clicking the Detail button next to each
object displays the Object Detail dialog box for each
record. You can review all the fields for the object
selected.
If you missed some critical information in
Robert Smith’s record, click the Detail
button next to his name. When the dialog box appears, copy
the information from any field to the Windows clipboard.
Now, click the Detail button next to John’s
record and paste the information into the appropriate field.
This feature enables you to avoid canceling the process and
starting over if you missed something.
- Click Finish to complete the
merge.
That’s it!
Now all the facts, issues and questions that were linked to
Robert Smith are linked to John Smith, as they should have
been in the first place.
Please keep in mind:
-
The
Object Link Merger moves only the links
between the objects. It does not
copy information from fields within each object to the other
object. For example, the Role in Case field has information
for Robert Smith. The Object Merger does not combine or copy
the information into John Smith’s record.

This
process cannot be undone. You will want to make a
backup of your CaseMap file before merging objects, just in
case you accidentally make a wrong choice in the process. If
